Voici les bonnes r\u00e9ponses face \u00e0 des situations qui peuvent se pr\u00e9senter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Question 1 :<br>R\u00e9parations locatives et charges locatives, c&rsquo;est pareil, c&rsquo;est FAUX.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il s&rsquo;agit de deux choses diff\u00e9rentes. Les charges locatives sont des d\u00e9penses engag\u00e9es et pay\u00e9es par le propri\u00e9taire, puis r\u00e9cup\u00e9rables aupr\u00e8s du locataire. Les travaux et r\u00e9parations doivent \u00eatre directement engag\u00e9s et pay\u00e9s par le locataire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Question 2 :<br>Le locataire peut demander un d\u00e9lai pour payer les charges, c&rsquo;est VRAI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En cas de difficult\u00e9s \u00e0 payer ses charges, le locataire peut demander au propri\u00e9taire des d\u00e9lais de paiement. Si le locataire et le propri\u00e9taire n&rsquo;arrivent pas \u00e0 trouver un terrain d&rsquo;entente, il est possible de faire appel \u00e0 un conciliateur de justice pour qu&rsquo;il les aide \u00e0 trouver ensemble la meilleure solution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Question 3 :<br>Il existe deux modes de paiement des charges, c&rsquo;est VRAI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il existe deux syst\u00e8mes de charges locatives. La provision sur charges (ou charges r\u00e9elles) pour tous les logements vides et hors colocation. Le r\u00e8glement des charges s&rsquo;effectue en fonction des d\u00e9penses r\u00e9ellement effectu\u00e9es. Les charges doivent \u00eatre r\u00e9gularis\u00e9es au moins une fois par an. Si les provisions sont sup\u00e9rieures aux d\u00e9penses r\u00e9elles, le propri\u00e9taire reverse le trop-per\u00e7u au locataire. Dans le cas contraire, il peut demander un compl\u00e9ment. Le r\u00e9gime forfaitaire s&rsquo;applique aux locations meubl\u00e9es et \u00e0 la colocation. Une somme fixe est inscrite dans le bail et celle-ci ne varie plus quel que soit le montant des charges forfaitaires. Pour \u00e9viter les d\u00e9rives, selon la loi Alur, il \u00ab\u00a0ne doit pas \u00eatre manifestement disproportionn\u00e9 au regard des charges dont le locataire ou, le cas \u00e9ch\u00e9ant, le pr\u00e9c\u00e9dent locataire se serait acquitt\u00e9\u00a0\u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Question 4 :<br>Le locataire peut demander des justificatifs au propri\u00e9taire, c&rsquo;est VRAI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les pi\u00e8ces justificatives des d\u00e9penses (factures, contrat d&rsquo;entretien\u2026) sont \u00e0 la disposition du locataire pendant 6 mois \u00e0 compter de l&rsquo;envoi du d\u00e9compte. Le locataire peut demander \u00e0 les consulter en adressant un courrier simple au propri\u00e9taire. En cas de refus, le courrier suivant sera en recommand\u00e9 avec demande d&rsquo;avis de r\u00e9ception.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Question 5 :<br>La r\u00e9gularisation des charges r\u00e9elles se fait une fois par an, c&rsquo;est VRAI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les charges r\u00e9elles doivent \u00eatre r\u00e9gularis\u00e9es au moins 1 fois par an, en comparant le total des provisions demand\u00e9es par le propri\u00e9taire au locataire avec les d\u00e9penses engag\u00e9es par le propri\u00e9taire pendant l&rsquo;ann\u00e9e. Si les provisions s&rsquo;av\u00e8rent \u00eatre sup\u00e9rieures aux d\u00e9penses r\u00e9elles, le propri\u00e9taire doit reverser le trop-per\u00e7u au locataire. Dans le cas contraire, le propri\u00e9taire demande un compl\u00e9ment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Question 6 :<br>En cas de contestation, le locataire peut refuser de payer les charges, c&rsquo;est FAUX.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00eame en cas de contestation, le locataire ne peut pas prendre l&rsquo;initiative de suspendre le paiement des charges ou de d\u00e9poser les sommes correspondantes sur un compte bloqu\u00e9. Le bailleur pourrait r\u00e9silier le contrat de location, se retourner contre la caution ou r\u00e9clamer les impay\u00e9s aupr\u00e8s de l&rsquo;organisme qui verse l&rsquo;aide au logement (Caisse d&rsquo;allocations familiales).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Question 7 :<br>Le propri\u00e9taire b\u00e9n\u00e9ficie d&rsquo;un d\u00e9lai pour r\u00e9gulariser les charges r\u00e9elles, c&rsquo;est VRAI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Selon la loi Alur, le propri\u00e9taire dispose d&rsquo;un d\u00e9lai de 3 ans pour r\u00e9cup\u00e9rer les charges et loyers impay\u00e9s, m\u00eame apr\u00e8s le d\u00e9part du locataire. Cependant, les tribunaux peuvent s&rsquo;opposer \u00e0 une r\u00e9gularisation tardive de charges si elle est consid\u00e9r\u00e9e comme d\u00e9loyale, brutale et cons\u00e9cutive \u00e0 une faute du propri\u00e9taire dans l&rsquo;ex\u00e9cution du contrat. C&rsquo;est notamment le cas si le propri\u00e9taire n&rsquo;a pas souhait\u00e9 proc\u00e9der \u00e0 la r\u00e9gularisation annuelle de fa\u00e7on d\u00e9lib\u00e9r\u00e9e. Dans ce cas, il peut \u00eatre condamn\u00e9 \u00e0 verser des dommages et int\u00e9r\u00eats au locataire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Question 8 :<br>Toutes les charges sont r\u00e9cup\u00e9rables, c&rsquo;est FAUX.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sont consid\u00e9r\u00e9es comme r\u00e9cup\u00e9rables certaines charges engag\u00e9es par le propri\u00e9taire et d\u00e9termin\u00e9es par le d\u00e9cret 87-713 du 26 ao\u00fbt 1987. Il s&rsquo;agit notamment : &#8211; des taxes locatives : taxes de balayage et d&rsquo;enl\u00e8vement des ordures m\u00e9nag\u00e8res ; &#8211; des d\u00e9penses de produits consommables (eau, chauffage, \u00e9lectricit\u00e9, produits et fournitures d&rsquo;entretien, ampoules\u2026) ; &#8211; des d\u00e9penses d&rsquo;entretien courant et de menues r\u00e9parations des \u00e9quipements collectifs et des parties communes.
